Terms and conditions for uploading photos.

By submitting your photo to brookeyewear.com, you hereby agree and consent to: Brook Eyewear, and its affiliates, subsidiaries, agencies (including advertising agencies), and parents, using the submitted photograph(s), video(s), comment(s) and other accompanying materials for advertising, marketing, promotion and other commercial and business purposes in accordance with these terms and conditions.

You should be of at least 18 years of age.

Only upload photographs or images that are relevant and appropriate to the product. The product should be prominent in the picture. The picture must also meet intellectual property, privacy, and other applicable laws.

You must hold the copyright of the images that you are uploading. Images that are considered to infringe the copyright or trademarks of other individuals, organizations or companies will not be permitted and will be removed. You must acknowledge that you have sufficient written permission (if necessary) of any recognizable locations or people appearing in the photograph to be able to grant us permission to use it on our website. If you think that your copyright to an image on our website has been infringed, please contact us via this page.

You must not upload photographs that contain objectionable content, including but not limited to nudity, violence, and other offensive, illegal or inappropriate images. Also, images cannot contain advertisements or links.

By uploading an image to brookeyewear.com, you permit Brook Eyewear, and its licensees and assigns, the unrestricted, perpetual, worldwide, non-transferable, royalty-free right and license to display, exhibit, transmit, reproduce, record, digitize, modify, alter, adapt, create derivative works, exploit and otherwise use and permit others to use in connection with the image uploaded on the product page or display at brookeyewear.com, in all languages and all media, whether now known or hereinafter devised, including without limitation on the Internet, on mobile platforms and/or devices, in printed materials, and in the advertising, publicity, and promotion thereof.

You should bear in mind that by uploading an image to our website, you are agreeing to indemnify us from any liability resulting from breaches of copyright of the image existing online on our website in digital form.

You also understand and agree that nothing in this agreement obligates Brook Eyewear to display or use your photograph(s). Pictures must be relevant and appropriate.

Brook Eyewear reserves the right in its sole and absolute discretion to alter these terms at any time for any reason without prior notice or to terminate the Photo Upload Service for any reason at any time without prior notice, whether removed from the entire website or removed from individual member accounts.

Brook Eyewear also reserves the right to reject and remove any uploaded photo from display on its website, for any reason, at any time, without prior notice. You hereby waive, release and forever discharge Brook Eyewear and each Authorized Person and each of their subsidiaries, affiliates, officers, directors, managers, members, shareholders, employees, representatives, and agents from any and all rights, claims, and liability relating to the use of the User Content in the manner contemplated above including, without limitation, any claims based on the invasion of privacy, commercial use of name or likeness and the right of publicity.

Mobile Terms of Service
Brook Eyewear

The Brook Eyewear mobile message service (the “Service”) is operated by Brook Eyewear (“Brook Eyewear”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Brook Eyewear’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Brook Eyewear through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Brook Eyewear. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +1 (888) 326-8793 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Brook Eyewear mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
